An MP3 on Termination Pay: When and How Much

Termination Pay: When to Pay It, How to Pay It, and How to Tax It
An employee's exit from your organization is the most dangerous time – from a legal AND tax perspective.

To find out if your termination pay practices are correct and compliant with federal and state employment tax regulations, take advice from payroll expert Mindy Harada in Termination Pay: When to Pay It, How to Pay It, and How to Tax It.
  • How quickly must you deliver that final paycheck? State laws vary: 14 days? 7 days? 72 hours?
  • What records should you retain for departing employees?
  • What are the rules on severance pay: Is it taxable for federal purposes? How about for state? If severance is paid, can the employee receive unemployment benefits?
  • Is there a difference between providing wage continuation versus lump sum severance?
  • Can you deduct from an employee's final paycheck to recoup for lost company equipment? Can you deduct amounts owed to you by the employee?
Understanding answers to questions like these are essential to your HR and payroll compliance. More lawsuits and fines are triggered by termination mistakes than at any time during the employees' tenure. And pay mistakes lead the way.

With Termination Pay, you'll discover:
  • How quickly you have to pay a terminated employee in order to comply with wage-and-hour rules
  • How to handle important withholding issues
  • Which records to keep (and which to toss) for terminated workers
  • How to reduce your FICA and FUTA tax and employee withholding
  • How to use Supplemental Unemployment Benefit Plans to cut your severance costs
Termination pay is one of your most complex and confusing duties. Don't go it alone … and don't try to guess at the compliance rules. The risks are way too high.

Make sure you have the information you need to make the right decisions and avoid expensive fines and lawsuits. Get your copy of Termination Paytoday!

Trick or Treat

Saturday, October 13, 2012
By CLAIRE AND JIM CASTAGNERA tneditor@tnonline.comJIM:According to the National Retail Federation, "More Americans than ever will be in the haunting mood this year, with seven in 10 celebrating Halloween, the most in NRF's 10-year survey history. On average, celebrants are expected to spend almost $80 on decorations, costumes and candy as total spending on the holiday is expected to reach $8 billion." [http://www.nrf.com/modules.php?name=Dashboard&id=54]Halloween springs from many ancient origins. Some scholars trace it back to Parentalia, the Roman festival of the dead. The Celts celebrated Samhain, which marked the end of autumn and the start of the cold season. For the Scots and Irish, the natural and supernatural worlds collided. The souls of the dead revisited their former homes. Early Christians appropriated the day as All Hallows Eve. November 1st is still All Saints' Day.Most American holidays are nothing more than long weekends anymore: Memorial Day, July 4th, Labor Day, and a few more if you happen to be a banker, a teacher or a government worker. Why, I have to wonder, does Halloween stand out, when it's not even an official U.S. holiday? When my kids were little, Halloween rivaled Christmas for generating enthusiasm. In the name of Parenthood, I variously was Dracula in my old polyester tux; Booboo the Bear, being dragged on a leash by my circus-performer daughter; and, "Mom," in a blond wig, skirt and stockings. That last one was the toughest. I kept getting hit on.Whatever the outfits, we always arrived home with bags of booty. The goodies got spilled onto the hallway carpet, where Marc and Claire bartered back and forth until each had an optimum mix of treats. The apples, if any, were turned over to us adults for inspection against razor blades. The kids feasted, brushed and were bedded down. Not such a big deal, right? So why all the excitement? I can't recall so much fuss about Halloween when I was a tyke. We lived for Christmas. Halloween and Thanksgiving were just short stops along the way. I have to wonder what changed.CLAIRE:My first guess would be that as a child (heck, let's not lie, even as an adult), I just really, really loved chocolate more than all my Christmas presents combined. Sure, I adored my little stuffed dog, Tuggles, but I couldn't eat her. I thought my new winter coat was cool and stylish, but it was no replacement for a frozen king-sized Snickers bar. (Like I said, I really love candy.) Even so, that doesn't explain why I've always preferred Halloween to Easter, another candy-centric holiday. My second guess is that I was, like many children, a little pagan at heart (again, let's not lie; I still am). Christmas and Easter are wonderful for many reasons I see now, as an adult, that I didn't understand as a child: the opportunity to be with family, finding the perfect gifts for loved ones, joy to the world and good will and all that. But when I was kid? Come on. It was all about the presents and the candy.I could barely sleep on Christmas Eve every year, I was so feverish with excitement. Thoughts of all the things I'd asked for on my Christmas list danced through my head, keeping me from even the smallest catnap. It was the same with Easter; I couldn't stop myself from imagining the bounty of chocolate and Peeps that would surely await me in the morning. The only thing marring this perfect image in my mind? I'm ashamed to admit it, but there's no use denying the truth. You may recall from previous columns that I once famously proclaimed, "I'd rather go to jail than church!" Well, church is kind of a staple of Christmas and Easter, is it not? Thus, you understand my childhood dilemma. The holidays, not to mention my enjoyment of chocolate, were constantly blemished by the prospect of church-going looming overhead. I would only have just begun to feast on my first (or fifth) Cadbury cream egg, and suddenly it was time to get dressed in a frilly outfit and head over to the house of God, who hadn't given me anything that year as far as I was concerned. I was too young to understand that I wouldn't even be getting Cadbury cream eggs if it weren't for God (and some crafty marketing by candy companies). The point of this soliloquy? I think it's obvious: Halloween requires no church attendance. Not only that, but it insists upon the very opposite of church troublemaking! Naughtiness! A rude poem that demands candy under threat of losing one's underwear! All of this while completely in disguise, rendering consequences nonexistent. Could anything be better to a child? It's not that church is so horrible, but can anyone honestly say that it's exciting? But that's what Halloween is; it's thrilling and forbidden and creepy and exhilarating. It's mischief and pranks; it's haunted house witches jumping out of coffins to scare the bejeezus out of you. Halloween is not built upon a moralistic story like every other holiday; it's built upon ghosts and campfire tales and the headstones of dead people. And that's simply fantastic. So parents, take heed: your children may be little darlings come the Christmas and Easter holidays, but in their heads they're all thinking the same thing. Just wait until Halloween …

Take Down the Tea Party Ten! CREDO Action | more than a network, a movement.

Dear Jim,It's official: This week, political forecaster Charlie Cook moved Michele Bachmann's race from Likely Republican to Lean Republican. That means Bachmann is vulnerable. And she is not alone.Every one of our races is competitive going into these final weeks. Every one.Chip in $5 to Take Down the Tea Party Ten and Michele Bachmann.Since we began our aggressive grassroots campaign, seven of our 11 campaigns have been shifted in our direction by political forecasters. And it's no wonder: Volunteers in our grassroots offices have already knocked on 41,088 doors. And made 538,799 phone calls. But to win, we'll need to drive these numbers through the roof. With your help, we'll have the resources to have knocked 20,000 doors in each district. We're preparing for a grassroots surge in the final weeks by hiring more organizers, opening more offices, and making sure we have the funds to keep our volunteers plugged into the predictive dialer tool, which doubles our voter contact rate, but costs 12 cents a minute for each volunteer connected to the system. This is what it will take to deliver big, shiny pink slips on November 6th to the likes of Bachmann, Steve King, Dan Lungren and Allen West.Whether we can pull it off is up to you.Chip in $5 to make sure we hold Tea Party extremists accountable on Nov. 6th.Thank you for everything you are doing,Becky Bond, Political Director

Democrats have the edge over Republicans in Florida, Iowa, Nevada and North Carolina. In Colorado and New Hampshire, Republicans outnumber Democrats, according to the analysis of state data. Three other battlegrounds — Ohio, Virginia and Wisconsin — don’t report registration statistics by party.

The Obama Truth Team on Ryan

To contact us Click HERE
Jim --

Over the course of his career, Joe Biden has always said exactly what he means, and people know they can count on the Vice President to be straight with them.

You can't say the same about Paul Ryan.

Out on the campaign trail, Ryan has followed Mitt Romney's lead -- making a habit of misrepresenting or flat-out denying his unpopular, extreme positions, while distorting President Obama's record. Both Romney and Ryan know that if they're honest with the American people about their proposals and their records, it'll hurt their chances to win the election. Take a look at this video about Paul Ryan's misleading ways, and share it with others before tonight's debate:

Video: Debate prep
Share on Facebook    Share on Twitter    Share via Email
Also be sure to check out this post that breaks down Ryan's favorite false attacks. Some examples include (but most certainly are not limited to):

-- Attacking President Obama for the Medicare savings that actually extend the life of the program.
-- Blaming President Obama for the closure of an auto manufacturing plant in Wisconsin that happened during the Bush administration.
-- Accusing President Obama of not taking the recommendations of the debt reduction committee -- the same recommendations that Ryan himself voted against.
-- Calling Obamacare a government "health care takeover."
-- Telling reporters that he hadn't sought stimulus funds for his district, when in fact he had.

After all this dishonesty, Ryan actually complained earlier this week that people are calling him dishonest. But until he proves otherwise, we will continue to say that water is wet, the sky is blue, and Paul Ryan and Mitt Romney are willing to say anything -- even if that means wildly distorting known facts -- to win this election.

So before, during, and after tonight's debate, head over to barackobama.com/debateand get the facts to respond to Ryan's distortions. And be sure to show your support for Vice President Biden on Facebook and Twitter, too.

Thanks for all you do,

Stephanie

P.S. -- Before the debate, take a look at this video of Rep. Chris Van Hollen -- Ryan's counterpart on the House budget committee -- laying out what to expect. And, of course, share it:

Supreme Court Ruling on SB 1070, Arizona's Immigration Law

To contact us Click HERE
On Monday, June 25, 2012, the US Supreme Court upheld the main provision of Arizona's crackdown on illegal immigrants but threw out three other parts.
These three provisions required immigrants to carry immigration papers at all times, banned illegal immigrants from soliciting work in public places, and requires state law enforcement officials to determine the immigration status of anyone they stop or arrest if they have reason to suspect that the individual might be in the country illegally.
Though the court gave the go-ahead to a key provision of Arizona's crackdown on illegal immigrants, it also warned that people could not be held for extended periods for not having proper immigration papers.
In their ruling, the justices said the federal government had the ultimate authority to decide who would be held on immigration charges and possibly deported. Arizona police officers must also check with federal immigration agents before deciding to hold any suspects, the court ruled. Federal immigration officials in Arizona were instructed by the Department of Homeland Security  not to respond to traffic stops or similar law enforcement encounters unless the person in custody was a convicted criminal, had been removed from the U.S. previously and reentered illegally or was a recent border crosser. They will, however, respond to telephone requests from local law enforcement to verify a detainee's immigration status.
Arizona became the first of half a dozen U.S. states to adopt laws to drive illegal immigrants out. About 360,000 of the country's illegal immigrants, or 3 percent, reside in Arizona. Most of the state's nearly 2 million Hispanics are in the country legally.  Arizona borders Mexico, where the foreign ministry issued a statement assailing the high political costs it said were attached to such laws and voicing concern for the civil rights of Mexicans living in or visiting U.S. states with such laws.
Last year, the court upheld a different Arizona law that penalizes businesses for hiring illegal immigrants.

CREDO Action | more than a network, a movement.Don't let Republicanssteal the 2012 election.Dear Jim,Florida is at it again. It's the scene of the crime where Secretary of State Katherine Harris helped Republicans steal the2000 presidential election for George Bush. But now it's Governor Rick Scott who is trying to steal the election for MittRomney.Earlier this summer, taking a page straight out of Katherine Harris' playbook, the Florida governor deployed a massive andsystematic effort to purge up to 182,000 voters from the state's voting rolls. Thanks to your activism and that of many others, we were able to generate massive public pressure, and the Department ofJustice issued a challenge to the purge. However, Gov. Scott threatened to defy the DOJ. It was Florida's county electionsupervisors, a group that included 30 Republicans, who emboldened by public support refused to go along with Gov. Scott'splan to steal the election.1But as it becomes clear that a win by Mitt Romney in Florida could decide the state's 29 electoral votes and the presidentialelection, Gov. Scott restarted his purge of registered voters. We have to act now to ensure the county supervisors of electiononce again block Gov. Scott's voter suppression scheme.Tell Florida's countysupervisors of elections: Don't allow Gov. Rick Scott to purge eligible citizens from the voting rolls. Click here to automaticallysign the petition. The Florida county supervisors of elections stood up and did the right thing this past June when they stopped Scott's votingpurge by refusing to use his "unreliable data" to purge their county's voting rolls.2 We need them to stand upagain. What is happening in Florida is the same old story of Republicans using the irrational fear of "voter fraud" as cover whilethey work to disenfranchise eligible voters. The truth is, voter fraud is exceedingly rare. More Americans are struck bylightning than commit voter fraud. As noted by legal scholar Jeffrey Toobin:
As many independent studies have found, "voter fraud" is a cure in search of a disease. There is no significant voter-fraudproblem in the United States. Rather, these laws are transparent attempts by Republican majorities to stifle and suppressthe number of minorities and poor people (mostly Democrats) who go to the polls.3
The real problem, the one that can affect the outcome of our elections if we're not vigilant, is voter suppression. Whichis exactly what Gov. Scott is trying to do, and it's part of a large-scale Republican crusade to suppress participation bymillions of voters in the 2012 presidential election. We need as many Americans as possible to protest Gov. Scott's latest scheme to disenfranchise voters. And we need to turnup the pressure now, before it's too late.Tell Florida's countysupervisors of elections: Don't allow Gov. Rick Scott to purge eligible citizens from the voting rolls. Click here to automaticallysign the petition. Let's make sure the election officials in Florida know that the whole country is watching, and we will hold them responsiblefor the integrity of their state's election which could decide the next president of the United States. We will not standby and let another illegitimate president be inaugurated because of a stolen election in Florida. In 2000, Florida's Secretary of State Katherine Harris provided the winning margin for George W. Bush by helping to "wrongfully"remove 7,000 Floridians — the overwhelming majority of whom were African Americans — from the voting rolls priorto the 2000 election.4 We will not let Gov. Rick Scott repeat this feat in 2012. Florida's county supervisorsof elections have stopped him before. They have the power to stop him again.Gov. Mitt Romney and President Barack Obama are locked in a tight election race which could very well be decided by Florida's29 electoral votes. We must take action now.
